TCE determina que prefeito de Bocaina anule aumento salarial de procurador
O Tribunal de Contas do Estado (TCE-PI), em decisão monocrática do conselheiro Kennedy Barros, determinou ao prefeito de Bocaina, Nirvado Silvino de Sousa, que declare nulo o decreto nº 42, que definiu o vencimento do procurador do município em 90,25% do subsídio de um desembargador do Tribunal de Justiça do Estado. A decisão atendeu a pedido do procurador Márcio André Vasconcelos, do Ministério Público de Contas, que considerou o aumento irregular e abusivo.
Assinado em 7 de outubro e publicado no Diário Oficial do Município que circulou no dia 11 de outubro, o decreto permite ao procurador do município ganhar R$ 27.500,16. Kennedy Barros deu dez dias para o prefeito anular o decreto. No relatório da decisão monocrática, ele justifica que a decisão do prefeito representa ofensa ao artigo 21 da Lei de Responsabilidade Fiscal (LRF), que diz ser nulo de pleno direito ato de que resulte aumento de despesa de pessoal nos 180 dias anteriores ao fim do mandato do gestor. Diz ainda que a decisão fere o artigo 37 da Constituição Federal.
Além de anular o decreto, o conselheiro determinou ainda que Nirvado Silvino anule todos os atos que tenham provocado aumento de despesas com pessoal no período em que o limite legal se encontrava descumprido e que o prefeito adote as medidas legais para readequar o limite de gastos com pessoal ao índice inferior a 54% da receita corrente líquida do município.
Localizada a 320 quilômetros ao sul de Teresina, Bocaina tem 4.369 habitantes e repasse médio de R$ 350 mil de Fundo de Participação (FPM) por mês. O PIB (Produto Interno Bruto) do município é de R$ 20.088,00.
